Introduction

  • Provide expertise and practical assistance to all assigned Sponsoring/ End-user departments of the Corporation in all tendering / contractual matters from inception of project till close-out of contracts.
  • Review and advise on SOR’s considering the best practice in tendering and contracting strategy.
  • Review and advise the pre-qualification documents, invitations and evaluation criteria prepared by Sponsoring Department and render expert advice in short listing potential bidders.
  • Suggest most appropriate Tendering process, i.e. Open or Classified or Single source and also most appropriate bidding process, i.e. Two bid or Two stage bidding system.
  • Prepare Tender Plan submissions in consultation with Sponsoring Department along with Tender strategy for Classified Tenders or Direct Selection.
  • Review and comment on the Scopes of Work/Services, and identify contractual gaps, unlimited liabilities, impossible requirements, including the verification of the completeness of the technical information supplied and discuss it as appropriate with Sponsoring Department.
  • Check anomalies/discrepancies, if any, in the tender document and ensure consistency throughout various sections of the tender document. Identify and prepare the most suitable pricing mechanism for a given scope of work/services, strictly as per Scope of Works/ Services.
  • Ensure risk assessments are adequately identified, and risk mitigation measures are addressed and managed as far as practicable in the Tender document.
  • Considering the various risks for the project including HSE Risk Management Guidelines.
  • Review and track the queries from tenderer during bidding phase.

What are you going to do 

  • Review the response of the technical queries prepared by Sponsoring Department and prepare responses of unpriced commercial queries thus ensuring quality and timely issuance of the Tender Bulletins. Participate in mid-tender meeting and site visits.
  • Participate in mid-tender meeting, site visits and face to face discussion with the Tenderers.
  • Involve thoroughly during technical evaluation of the bids, especially for commercial and contractual compliances and if there are any gap, prepare clarifications required.
  • Address various issues concerning deviations to General Conditions of Contract, technical and unpriced commercial deviation and ensure each of such issues are responded through Tender Clarification.
  • Coordinate closely with the Technical Evaluation team in order to ensure that each and every issue under the Technical proposal submitted by Tenderers which require clarification are addressed in a timely manner until the bids are fully or substantially compliant to the Tender requirement.
  • Coordinate with Sponsoring Department in preparation of Technical Evaluation report for review by the other evaluation committee members.
  • Lead the Commercial evaluation, analyse the commercial proposal and prepare the Commercial Tabulation and Evaluation Report, convene meeting with the Commercial Evaluation Team members and ensure that it is submitted to the concerned Tender Committee on a timely manner.
  • Ensure that the tendering process, both Technical and Commercial Evaluation are conducted in a fair and ethical manner and are consistent with the terms and conditions of Tenders, Policies, Guidelines and Procedures and the evaluation criteria apply equitably to all received bids.
  • Coordinate with Sponsor Department proactively immediately after Commercial Evaluation Report & Award Plan submission for necessary inputs for the Letter of Award and ensure its timely issuance to the Selected Tenderer.
  • Having issued the Letter of Award, commence preparation of the Contract document in consultation with Sponsoring Department, ensuring that all changes through Tender Bulletins/ Tender Clarifications are incorporated in the Contract document.
  • Initiate review process of the draft Contract document, finalise it with inputs, if any from other concerned Departments and issue the Draft Contract for review and execution by the Contractor.
  • Continue to support the Sponsor / End User in day-to-day execution and administration of the Contract in all correspondences, submission of applicable bonds and insurances as and when required.
  • Change Management Process is an important area and Senior Contract Engineer has to critically contribute towards minimisation of the changes by critical review of all Changes proposed by either Parties.
  • If changes proposed are found admissible, provide advice and support to SDs for finalising the preparation and issuance of the Change Requests (CRs) to the Contractor for their proposal.
  • Review and evaluate the CR proposals and provide practical assistance in the completion of evaluation of the CR proposals and prepare the necessary submissions in consultation with Sponsoring Department to concerned Tenders Committees, for timely award of Variations / Amendments based on RPWA and CCPM procedures.
  • Provide advice regarding mitigations of Contractor’s claims
  • Ensure the Close-out process is initiated by SD on a timely manner and review the Completion Certificates (CC), Statement of Final Accounts (SFA), Close out Report (COR) Contractor Performance Evaluation (CPE) and Discharge Certificate (DC).

Essential skills and knowledge 

  • BSc in Engineering Discipline. A post graduate qualification in Contract Management or Project Management desirable.
  • 12 years multi-disciplinary experience in contract execution, including minimum 6 years in offshore Tenders/contracts (Study/FEED as well as EPIC) for Process platforms, Living Quarter, Compressor Platform, wellhead platforms and production, gas lift and water injection lines, submarine power cables, subsea skids and umbilicals and associated brownfield modification at existing platforms.
  • Extensive experience in all aspects of tendering activities related to high/mid value & complex offshore Engineering Contracts for Feasibility/Concept Optimization studies, Pre-FEED, FEED & EPIC in oil and gas industry.
  • Experience in Contracting Strategies Development & Implementation, Prequalification, review of Scope preparation of Tender document, Pre-Award & Post Award Tender clarification / signing of Contract doc & its administration, Negotiations, Variations to Contracts, Claims Management.
  • Possession of sound knowledge of Contracts Law is desirable.
  • Proficient in contractual correspondence, contract verbatim, report writing with analytical, logical and problem-solving skills.
  • Thorough understanding of engineering, procurement, construction techniques EPIC / EPCM & LSTK.
  • Other forms of contracts such as FEED/ECS/ Construction/ Consultancy contracts and related works/services.
  • Computer literate and able to use this knowledge for contract analysis, evaluation of statistical data both historical and projected.
  • Preferably experienced in managing contracts in SAP MM-ES and the day-to-day transactions and management.
  • Quality/safety focus.
