Introduction

  • The primary role is posting award contract administration function. Incumbent is expected to

    look at post award contractual issues objectively and resolve disputed change orders with support of C&P in proactive manner and achieve appropriate resolutions. Key accountabilities:

    • Provide a quality, cost-effective and time efficient post award contracts administrative service to E&C.
    • Review different types of contracts/agreements for the projects prepared by C&P.
    • Administer the contracts and ensure all terms and conditions are implemented/adhered by all projects.
    • Review/propose contracting strategy & plan for different types of projects.
    • Implement COMPANY norms and procedures for all contracts and consciously monitor implementation.
    • Develop/review change order packages and ensure compliance to CONTRACT guidelines and procedures, propose/develop negotiation strategies for change orders.
    • Ensure implementation of the supplier performance evaluation by project teams and Conduct / participate in counselling sessions with low performing contractors and log the required actions.
    • Provide feedback to project teams regarding contract terms and conditions to avoid occurrence of disputes or breach to the contract.
    • Perform contract closeout actions upon project completion.
    • Prepare/review contracting reports to management.
    • Uphold work ethics and maintain high standards of professional behavior and conduct.

What are you going to do

  • E&C CONTRACT Focal and Main Interface Internally and Externally
    • Provide technical guidance, support to project teams and departments in Contracts Administration, based on a detailed and multi-disciplinary understanding of the area of specialization.
    • Develop and identify improvements to processes, procedures, risks, impacts, and controls and lead the resolution of related complex issues.
    • Develop and implement operating and reporting procedures to comply with complex procedural agreements.
    • Develop and present to senior management with quality analysis and recommendations on complex contracts issues.
    • Provide interpretation and guidance to ensure that all reports and records comply with applicable standards, statutory regulatory requirements and internal policies and procedures.
    • Perform investigations for identifying and resolving issues, recommending the most appropriate and cost-effective approach.
    • Interact regularly with managers and staff in other groups and departments for the purpose of providing strategic advice and guidance.
    • Support in managing the activities undertaken by contractors/vendors, maintaining high performance of contracts, development of new contracts, management of contract changes, contract governance for critical contracts and contracts closes out.
    • Participate and lead in technical/contracts meetings with internal & external customers, mentor staff to develop their capabilities, drive the implementation of best practice, lead implementation of COMPANY requirements pertaining to contracts administration.
  • Initiation of CONTRACTS:
    • Identify and define all contractual/outsourcing needs for E&C under the supervision of E&C Head Project Controls & Services. This includes:
    • Meticulous demand gathering workshops among various project teams.
    • Formulating comprehensive CONTRACT Acquisition Plans for further inputs to C&P to initiate procurement Process i.e., Establishments of New Contracts, Funds enhancements and renewal of existing Contracts.
    • Preparation to validate the contract’s strategy through close collaboration with E&C Technical DUET and attending COMPANY’s CONTRACT committee and COMPANY’s shareholder CONTRACT committee meetings (as required).
    • Review/Initiation of Scope of Work along with performance KPIs.
    • Defining Technical Evaluation Methodology and Scoring Matrix
    • Peer review of CFT packages (technical Exhibits, General and Particular specifications, the management of the clarification / negotiation phases, the evaluation of technical proposals and the issue of final technical report.
    • Preparation and follow-up of the associated commitment process, including COMPANY’s CONTRACT committee and COMPANY’s shareholder CONTRACT committee for deliberation of Technical Evaluation Report
  • Administration of CONTRACTS:
    • Contractually and commercially manage the awarded Contract(s) and liaise actively with relevant technical specialists for the technical management of Contractor(s) and Contract & Procurement Division for contractual and commercial matters.
    • Analyze the contractual correspondence/documentation received from ENGINEER / CONTRACTOR and prepare the necessary answers.
    • Ensure timely submission and adjustment by ENGINEER / CONTRACTOR of guarantees and certificates as per the CONTRACT.
    • Participate in meetings and Change Order meetings with ENGINEER / CONTRACTOR and prepare/review the corresponding MOMs.
    • Ensure payment is in accordance with the claimed progress.
    • Draft contractual and commercial letters and minutes of meetings held with ENGINEER /CONTRACTORS.
    • Verify the ENGINEER / CONTRACTOR’S progress in coordination with the Planning Engineer and Budget and Cost Controller
    • Monitor all Cost remuneration to ENGINEER / CONTRACTOR and participate in the compilation of Milestone Payment Certificates and Contractor Invoices.
    • Participate to meetings with ENGINEER / CONTRACTOR and, in general, to all necessary meetings as requested and as defined in Contracts.
    • Participate in the settlement of disputes together with legal, insurance and finance specialists.
    • Perform the close-out of CONTRACT(s) with respect to the COMPANY procedures.
    • Participate in reducing contractual risks and highlighting potential risks occurring during the execution of the CONTRACT.
    • Ensure that clear and accurate records of contractual matters are maintained and monitor key dates, against dates defined in the CONTRACTS.
    • As a general manner, to manage all contractual and commercial activities related to CONTRACT(s) he is in charge of, up to close-out, in the frame and with respect to procedural obligations and in strict compliance of delegation of authorities and associated Contract and Procurement procedures.
    • Timely report to management as required and highlighting progress and encountered areas of concern.
  • Subcontracts:
    • Ensure that ENGINEER / CONTRACTOR performs all purchasing and subcontracting activities in accordance with CONTRACT requirements.
  • Change Orders:
    • Analyze the Change Order Requests (CORs) received from ENGINEER / CONTRACTOR and prepare recommendations.
    • Prepare and issue the CORs initiated by COMPANY and then the necessary Change Orders (COs) for formal signature.
    • Obtain approval from COMPANY C&P and Legal Divisions when modifications need to be made to the CONTRACT.
    • Follow-up the CO circulation and review the CO register maintained by FEED / CONTRACTOR
    • Participate to Change orders meetings with CONTRACTORS. Manage the process associated with contractual and commercial changes (changes orders) according to Change Order Procedure and Delegation of Authorities in force, coordinate requests for technical changes and follow-up related approval process.
    • Ensure confidentiality of all the contractual and commercial documentation produced (whatever its support).
  • Reporting to and Coordination with Project Management:
    • Coordinate with the E&C project teams and Cost Controllers as required.
    • Liaise with COMPANY organizations (including C&P, Legal, Insurance, as required).
    • Be focal point to E&C to coordinate actions with C&P and legal teams.
    • Serve as a liaison between internal and external parties during contract execution.
    • Work with different levels of personnel within an organization to analyze and solidify an overall contract strategy.

Essential skills and knowledge 

  • B.Sc. Degree in Engineering. Full membership of a recognized professional body (e.g. CIPS, ISM. P.ENG. IACCM) shall be considered an asset.
  • Fifteen (15) years of specialized contracting experience in design, consultancy, Joint Ventures,

    And construction contracts/agreements related to oil & gas installations, such that the incumbent is clearly recognized as an expert in this field.

  • Excellent English communication skills (verbal and written).
  • Must have an expert understanding of contract administration principles and best practices.
  • Dynamic attitude towards process improvements
  • Flexible to work in multinational teams and mobilize to different locations as needed
